These Terms and Conditions (“Terms”) govern your access to and use of the Website and the purchase of Products from us. If you do not agree with any part of these Terms, you must not use the Website or purchase any Products.

These Terms are provided in English and Arabic where required by law. In case of any discrepancy, the Arabic version shall prevail.

1. Acceptance of Terms

These Terms constitute a legally binding agreement between you and BeAura Active. We reserve the right to update or modify these Terms at any time. Changes will be posted on the Website, and your continued use constitutes acceptance of the revised Terms. It is your responsibility to review these Terms periodically.

2. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) and a resident of (or shipping to) a country we deliver to. By using the Website, you represent that you meet these eligibility requirements and have the legal capacity to enter into contracts.

3. Account Registration

To make purchases, you may need to create an account. You are responsible for providing accurate, complete information and maintaining the confidentiality of your account credentials. You agree to notify us immediately of any unauthorized use. We reserve the right to suspend or terminate accounts at our discretion, in line with applicable laws.

4. Products and Orders

Product Descriptions: We strive to display Products accurately, including colors, sizes, materials, and specifications. However, colors and designs may slightly vary due to lighting and screen differences. Information about Products is provided in Arabic and English as required.

Pricing: Prices are in UAE Dirham (AED) and include 5% VAT unless stated otherwise. Prices are subject to change without notice, but changes will not affect confirmed orders. We reserve the right to correct pricing errors.

Order Acceptance: All Products are subject to availability. Orders are subject to acceptance and availability. We may refuse or cancel orders for reasons including unavailability, errors, or suspected fraud.

Size charts are provided on each product page – please refer to them before ordering. We are not responsible for incorrect sizing if the chart was not followed.

5. Payment

Full payment is required at the time of order. We accept payments via credit/debit cards, Apple Pay, Google Pay, and bank transfer through secure payment gateways compliant with UAE Central Bank regulations. You authorize charges for the total amount, including shipping, taxes, and VAT. All transactions comply with UAE regulations on digital payments.

6. Shipping and Delivery

UAE: Free shipping on orders above AED 299 (within UAE mainland). Standard delivery: 1–3 business days (Dubai & Sharjah), 2–5 business days (other emirates). Cash-on-delivery (COD) is available with an extra AED 20 fee.

International: Shipping is available to GCC countries and other regions (additional charges apply). Shipping costs, methods, and estimated times are displayed at checkout.

Risk of loss passes to you upon delivery to the carrier. We are not liable for delays due to carriers, customs, or force majeure.

7. Returns, Refunds, and Exchanges (Hygiene-Sensitive Clothing Policy)

Because activewear is intimate apparel and worn close to the body, the following strict hygiene rules apply under UAE Consumer Protection Law and international best practice:

In compliance with UAE Consumer Protection Law: for defective or non-conforming Products, you have the right to repair, replacement, or refund.

We offer returns/exchanges for change of mind within 7 days of delivery for unused Products in original condition with tags. Certain items (e.g., personalized, hygiene-related, or sale items) may be non-returnable.

Return shipping costs are your responsibility unless the Product is defective (in which case, we cover costs).

Refunds are issued to the original payment method within 14 days of receiving the return.

8. Warranties and After-Sales Service

We honor all manufacturer warranties and provide after-sales support as required by law. Products are intended for general fitness use; consult professionals for specific advice. We are not liable for injuries from misuse.

All content on the Website is owned by us or our licensors and protected by UAE and international laws. Unauthorized use is prohibited.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of the United Arab Emirates, including Federal Law No. 15 of 2020 on Consumer Protection and Federal Decree-Law No. 14 of 2023 on Trading by Modern Technology. Any disputes shall be resolved amicably first. If unresolved, they shall be subject to the exclusive jurisdiction of the courts in Dubai, UAE, or through the competent authorities such as the Department of Economy and Tourism or Ministry of Economy.
